1. Your Physical Condition and Safety

a. You understand that it is your responsibility to consult a physician regarding your ability to participate in the physical activities and/or use of the PURE Facilities and/or the PURE Equipment, and that participating in the physical activities undertaken at PURE and use of the PURE Facilities and/or the PURE Equipment imposes physical demands upon you, and in particular you understand that the yoga instruction provided in the PURE Yoga sessions (the “PURE Yoga Sessions”) and PURE South Sessions (“PURE South Sessions”) will be held in a heated and humid environment of between 30°C and 40°C and with up to 97% humidity, which will impose extra physical demands on you over and above those which you would experience at cooler temperatures, and in lower humidity when engaging in any or comparable exercise.
b. You shall not use any of the PURE Facilities and/or the PURE Equipment or participate in any of the physical activities available at PURE whilst suffering from any infections or contagious illness, disease or other ailment including but not limited to open cuts, abrasions, open sores or minor infections, where there is any risk that such use or participation in such condition may be detrimental to the health, safety, comfort or physical condition of other users of Pure; you will bring any such matters to the attention of the staff of PURE if in any doubt.
c. The PURE Facilities and/or the PURE Equipment may result in harm to you, especially if you have not received instruction in their use by one of PURE’s instructors; all equipment is different and even if you have used similar equipment it is essential you are familiar with the use of the PURE Equipment. You must seek advice from PURE’s instructors on the correct use of the PURE Facilities and/or the PURE Equipment and must not use any of the PURE Facilities and/or the PURE Equipment if you are not sure as to their safe and proper use.
d. Any person who is pregnant, under medication and/or suffering from or having suffered from any medical disability is strongly advised to seek the advice of a qualified medical practitioner before using any of the PURE Facilities and/or the PURE Equipment and before taking part in any physical activities in the premises of PURE.
e. No person who is under the influence of drugs or of alcohol is permitted to use the PURE Facilities and/or the PURE Equipment and/or take part in any physical activities in the premises of PURE.

2. Limitation of Liability

a. You hereby acknowledge that you are aware that in participating in the physical activities available at PURE Fitness, the PURE Yoga Sessions, or PURE South Sessions, and in using the PURE Facilities and/or the PURE Equipment there is the risk or possibility of injury and, without restricting the generality of the foregoing, in particular with the use of the Swimming Pool, Boxing Ring and Climbing Wall facilities. You voluntarily accept these inherent risks. You further warrant that you have consulted a qualified medical practitioner recently and know of no reason why you should not participate in physical activities available at PURE in which you will participate. You promise that you will use the PURE Facilities and/or the PURE Equipment at all times in accordance with the instructions as to the use provided by PURE and you acknowledge that PURE will not be liable for injury or damage sustained if the PURE Facilities and/or the PURE Equipment are used before you have received proper instruction or contrary to such instruction.
b. To the fullest extent permitted by applicable law, PURE, its related corporations and their respective servants, agents, employees and staff (collectively referred to in this Clause 2 as the “PURE Group”) shall not be liable for any loss or damage to property or in respect of any bodily injuries, illness or death of you, your guests and/or other persons including third parties within the facilities, howsoever caused, aggravated or incurred arising out of or in any way connected with but not limited to any behavior of you or your guests, the use of the PURE Facilities and/or the PURE Equipment and other services.
c. You hereby acknowledge that you understand and voluntarily accept the risks of injury involved in the use of the PURE Facilities and/or the PURE Equipment. To the fullest extent permitted by applicable laws, you hereby agree the PURE Group shall not be liable in contract, tort (including without limitation negligence), pre-contract or other representations or otherwise out of or in connection with your participation in PURE Yoga Sessions or PURE South Sessions and/or usage of the PURE Facilities and/or the PURE Equipment, for any claims, demands, damages, economic losses (including without limitation, loss of revenues, profits, contracts, business or anticipated savings), loss of good will or reputation, or special or indirect consequential losses in any case. You further agree not to hold the PURE Group liable for any willful act or omission, default, fraud or negligence of any other person or guest or third party within PURE operated facilities.
d. You hereby agree to defend, fully indemnify on demand and hold harmless the PURE Group from and against all liabilities, claims, expenses, damages and losses including legal fees (on an indemnity basis) which PURE Group may suffer arising from any breach of these terms and conditions by you, or in connection with any act, omission, default, negligence or conduct of you or your guest, or in connection with any other liabilities arising out of your or your guest’s use of the PURE Facilities and/or the PURE Equipment or any services under this Agreement. This obligation to indemnify PURE shall survive the termination of this Agreement.

3. Personal Information

PURE operates a privacy policy, full details of which can be obtained form its websites at www.pure-yoga.com and www.pure-fitness.com, you are under no obligation to provide any personal data, however, so that PURE is able to provide you with its services and products, the minimum information we need is your name, telephone number, email address and postal address.
